  1. Happy New Year Naked Investors Colleagues. I have a client who is interested in a lease purchase in Indianapolis. Now that the Dodd-Frank legislation is upon us, I would like ot secure the services of A Registered Mortgage Loan Originator. Please help!   4. Hi Michael and fellow NI's, I have a property owner in Indianapolis that is willing to lease purchase his vacant home. He lives in the neighborhood. I have advertised the property and recently got a phone call from a potential tenant-buyer. He has agreed to the sale price and an assignment fee of $8K. I DO NOT intend to stay in this deal. Michael, which forms do I use with the seller? I intend to assign the lease purchase to the tenant-buyer, instead of a sandwich lease. Do I use my lawyer to hold the assignment fee in escrow? In the documents to the seller I put in the agreed upon price, is that price then negotiable with the Tenant-Buyer and Seller or is that price firm? Thanks for the assistance. Charles

Hi Michael, The property manager is aware and any new renters (that might qualify for a L/O) will be referred to me.I have chosen to leave signs out of the yard to avoid any intrusions by unscrupulous persons. I do know this area. While I would chose to not live there, others will find a nice home in a transitory neighborhood to their liking. Craigslist will be my major ad choice followed by my website.

I will require $2,250.00 non-refundable option consideration, with the home purchased within 3 years. The home is to be sold for $47,250.00 at the time of exercising the option. Monthly lease of $700.00. The property is free and clear. Currently taxes are $236.00 and Insurance is $450.00. I have a property manager manage the property. This home is located on the north side of Indianapolis on West 35th. Street. Being from Indianapolis, I know this area. It's in the inner city in a predominately African American community, and that may be a drawback to some. This home will work for someone who wants a starter home. Hi Michael, I have a question about what information to include in part 2 of PRORATIONS AND CLOSING COSTS: (1) Real property taxes on the property, and general and special assessments, if any, for the current fiscal year shall be prorated to the close of escrow and paid by the Seller/Landlord.   10. Keep the property rented, raise rents next year if that makes sense and purchase the property when the mortgage comes due in 2016. Buy and hold for long term appreciation and my retirement fund.
  11. Michael, I am in discussion with a seller and the opportunity exist for owner financing. Will I use the short offer form to present to the seller? Another question related to owner financing. Let's say the owner agrees to owner financing and wants $20,000 down. Would it make sense to get an investor to put up the $20K with a ROI of 8% per year? Thank you
  12. Hi Michael, July 1st. is Canada Day. Happy Canada Day to Canadians on this site. Similar to July 4th.in USA. The owners and I have reached an agreement and I now have this property. I'm happy with this deal and I recognize the risk involved.
  13. There are 2 options I have thought about. I will share the one I like the least. Walk away from the propery and let the owner do a short sale. This will wreck their credit for about 3 years. Less than positive feelings on my part about that decision! The one I prefer is to discuss owner financing and using a wrap. The market here is currently flat, however; I am stoked about getting a duplex with only $10.00 up front! My risk-tolerance is high and I want this property for my first buy (Get) and hold! Since I would have been managing the property for three (3) years and removing there "headache", keeping an open and communicative relationship with the owner, and not backing out, I think we can come to an agreement that will be a win for all concerned.

  15. Hi Michael, I would love to keep this for myself. I have spoken with the owner's who live in Alberta and the property is in British Columbia. The owner's want this problem gone! I will take over paying the mortgage from the rental income. The mortgage comes due in 2016 and I have the right of first refusal. My lawyer's documents allow for this! If necessary, I will create a joint venture to hold this property. The market is pretty flat in that part of BC; however, I think it will bounce back. This is the Napa Valley of BC. The mortgage balance is $477K, the property is underwater $50K.
  16. Hi Everyone, Has anyone have any experience with this? If a property has negative equity, (a duplex) what would you do? Walk away, try to get the property??? The reason I ask this question is because I found a property with an out of area owner that has negative equity/upside down on their mortgage and wasn't sure if I should even consider pursuing this property. I am in communication with the ownersand they want their headache gone. My lawyer has drawn up documents that will allow me to take over paying the mortgage, collecting rents of $2700/mo. to pay a mortgage 0f $2263.00/mo. I would also have power of attorney with right of first refusal. Any advice or input is greatly appreciated.

  19. Okay, heres the deal. I have been working with a tenant/buyer who has his eyes on a condo for him and his son. Father is in the midst of a divorce and needs to find a home for him and his teenaged son. I have a seller I got through the For Rent By Owner on the internet. I called the owner, shared the story about our father/son situation and asked if he would consider selling the condo. I told him the dad, a lawyer, was adamant that he live in the same community where his son attends high school, and that he (dad) did not want to make a landlord rich with $1200/mo. rent. He will buy instead. There was a moment of silence as the homeowner thought about the situation and said, lets talk about it. The home owner agreed to sell the 2 bedroom 1 bath condo for $252,500.00. After running comps on the condos sold in his complex, his asking price was fair. He has a mortgage with PITI of $1000.00. Current tenant is paying $1300.00 per month. Current tenant will be leaving at end of April. I will set the buy price for the tenant.buyer @ 4% above the FMV which will be $265,600 in 2 years, with a $10,000 option consideration. The rent will remain at $1,300.00 per month. I know that the $10K is a non refundable fee that is credited to the purchase price or down payment. I am unclear as to how the $10K is credited to the T/B. What form do I complete that addresses this? Who gets copies of the form(s)? How is the $10K recorded so that at the end of 2 years, the money is credited to the T/B. Is the $10K held in escrow or in my bank account? Please tell me my bank account is the happy holder of this money. Is the money eventually. If the seller wants some of the option money how and when is that distributed? I ask these questions so I can answer the seller and buyer about the option consideration from a position of integrity and professionalism. Walking me through this is greatly appreciated.   20. I have 2 people in Indiana who are in pre-foreclosure and are interested in the lease option strategy. Now in 2013 is it a good idea to pursue pre-foreclosures using a lease option strategy? I have been speaking with a person who works for a title company and the idea of having the mortgage payments sent directly to the leander avoids the possibility of the owner using the money for other things. I also want to make money on the deal and help the homeowner too! Has anyone done l/o this year with a pre-foreclosure homeowner? Does the bank need to be informed of this strategy? What are the pros and cons? Thanks
  21. Greetings MC, I have a potential seller who is asking about the process of selling his home on a L/O. The property is in southern california, 3/3, 1,357 sq.ft. townhouse,asking $375,000. We have been exchanging emails and here is the chronology of his questions over the past 4 days: 1. If you want to buy the house, why do you want to lease it? 2. Thank you for your response. If after one year, the tenant does not want to pursue buying the house, is the buyer back to square one or will you be buying the house? 3. What if the tenant wants to back out and doesn't want to buy? 4. Where are you located? Can you provide me a list of our current rental properties? 5. Can you give me a small list of prior homes that you have closed using the tenant-buyer program? I have not closed on any homes, so I am looking to "borrow benefits" from you. What this means is asking you to speak, via email, to this homeowner about YOUR succes with T/B's and that I am using your course material, which has an astonishing track record. I would also appreciate this potential client knowing that I am being coached by you. Thanks Michael
