Sale of home owned from less than two years

Hi,

 

I have a question concerning like-kind exchanges and your personal residence. I know that section 121 and a 1031 exchange are mutally exclusive, however, if you don't meets the eligibility requirements to exclude the 250,000/500,000 capital gains on the sale of your principle residency b/c you only lived in the house for 4 months, if I then sale the home and purchase a new one, is the gain eligible for 1031 treatment?

No, your personal residence is not eligible to participate in a 1031 exchange.

 

Why are you selling? There are exceptions to the 2 year rules for the Section 121 exclusion.
