Hi Everyone first post here at this forum. Looking foward to get into LO business. I live in the Boston area, Should I stay away from any property built before 1978 that has not been deleaded? Any ideas?

Hi, Jeff, and welcome aboard. Interesting topic. What is the state law regarding lead paint? Who is responsible for what when it is present in a property?

In Ma. The landlord is responsible for deleading the apt. or house if a child is iving there under 7 years old. You can not discriminate, you must delead if you rent to families.

So before a house can be leased all traces of lead paint must be removed? If buying outright it seems clear a test for lead paint be done, and then insist the seller take care of it, or negotiate the price to reflect the presence of the lead paint.
I think the best advice is to contact an attorney regarding who's responsibility it becomes when doing a sandwich lease.
